1. Acceptance of the terms
By downloading, installing or using Pocket Beat Maker (the “App”) or this website, you agree to these Terms. If you do not agree, do not use them. Your use of the App is also governed by the End User License Agreement.
2. Product description
The App is an Android beat-making tool with drum pads, a step sequencer, song arrangement, master effects and WAV export. It works on the device and does not require an account.
3. Eligibility and applicable law
You must be able to form a binding agreement under the law where you live, or have a parent or guardian’s permission as Google Play’s terms require. Nothing in these Terms removes consumer rights that cannot be waived under your local law.
4. Relationship with Google Play
The App is distributed through Google Play. Google is not a party to these Terms, is not responsible for the App, and is not obliged to provide support for it. Google Play’s terms govern your purchase and download.
5. One-time purchase model
The App is sold as a one-time, upfront purchase on Google Play. It contains no subscriptions, in-app purchases or advertisements. Price and availability are set on Google Play and can vary by country. See Refunds & Purchases.
6. License to use the App
Subject to these Terms and the EULA, you receive a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Android devices you own or control, as permitted by Google Play.
7. Personal, lawful use
Use the App for lawful purposes only, and do not use it in a way that infringes anyone’s rights.
8. User-generated music and project files
Beats, patterns, projects and exported audio you create are yours (see the next section). They are stored on your device; keep your own backups of work that matters to you.
9. Ownership of your original work
We do not claim ownership of the music you create. You own the original creative choices you make, such as your patterns and arrangements, subject to the rights of any third parties in material you add elsewhere, and subject to the licence for the bundled sounds below.
10. Rights in the App, code, branding and sounds
The App’s software, design, name and logo belong to the developer and its licensors and are protected by law. These Terms do not transfer any of them to you.
11. Sample and preset licensing
The 80 sounds bundled with the App are original works generated for the project and released under CC0 1.0 Universal (public-domain dedication), as recorded in the App’s licence inventory. In practice, you may use the sounds in your own music, including commercially, with no attribution required. No third-party samples are included. This applies to the sound files themselves, not to the App’s software, name or logo.
12. Redistribution of bundled audio
Because the bundled sounds are CC0, we do not restrict their reuse as such. Please note, however, that the App’s software and brand remain protected: you may not redistribute the App, or a modified copy of it, in a way that the EULA forbids.
Review note. If the sounds’ CC0 status changes in a future version, or third-party content is added, this section must be revised.
13. Prohibited use
- Copying, redistributing, reselling or sublicensing the App, except as law or the EULA allows.
- Reverse engineering the App, except where mandatory law permits.
- Removing notices, or using the App’s name or logo in a misleading way.
- Using the website or App to violate the law or to harm others.
14. Intellectual property
All trademarks are the property of their owners. Google Play and Android are trademarks of Google LLC. If you believe content in the App or on this website infringes your rights, contact us at the address below.
15. Third-party components and services
The App includes open-source components (for example Oboe, AndroidX and Kotlin libraries) under the Apache License 2.0. Their notices are available inside the App (Settings → About). Google Play and Android are third-party services with their own terms.
16. Updates and compatibility
We may release updates to fix problems or add features. The App requires Android 8.0 (API 26) or newer. We cannot promise it will work on every device, or that it will keep working with future Android versions.
17. Disclaimer of warranties
To the extent permitted by law, the App and website are provided “as is” and “as available” without warranties of any kind, including fitness for a particular purpose. We do not warrant uninterrupted or error-free operation or specific audio latency. Mandatory consumer guarantees that apply in your country are not excluded.
18. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for lost projects or data. Nothing in these Terms limits liability that cannot lawfully be limited, such as liability for death or personal injury caused by negligence, or for fraud.
19. Indemnity
We do not ask consumers to indemnify us beyond what applicable law allows. If you use the App in the course of a business, you are responsible for claims arising from your own unlawful use, to the extent the law allows.
20. Suspension or termination
Your licence ends if you materially breach these Terms or the EULA. You can stop at any time by uninstalling the App. Provisions that by nature should survive (ownership, disclaimers, liability) will survive.
21. Changes to the terms
We may update these Terms; the “Last updated” date will change. Material changes affecting existing purchasers will be announced on this page, and continued use after an update means you accept it, where the law permits.
22. Governing law and dispute resolution
Governing law and jurisdiction not yet confirmed. This must be completed before publication.
23. Contact
Questions about these Terms: Contact address not yet published. This must be configured before launch.
