This End User License Agreement (“EULA”) is between you and the developer of Pocket Beat Maker (the “App”). It supplements the Terms of Use. It does not override Google Play’s terms or any consumer rights you have that cannot be waived by law.
1. License granted
On purchase through Google Play, you receive a personal, non-exclusive, non-transferable, revocable licence to use the App, in object-code form, for your own non-commercial or commercial music-making purposes.
2. Installation and permitted use
You may install and use the App on Android devices you own or control, within the limits Google Play sets for your account (for example, family sharing where available and enabled).
3. Restrictions
Except where mandatory law gives you the right, you may not: copy the App other than for normal installation and backup; modify it or create derivative works; reverse engineer, decompile or disassemble it; rent, lease, sell, sublicense or redistribute it; or remove proprietary notices.
4. Ownership of the App and brand
The App, including its software, design, name and logo, is licensed, not sold. All rights not expressly granted are reserved.
5. Open-source components
The App includes open-source software, including Oboe, AndroidX, Jetpack Compose, Material 3 and Kotlin libraries, licensed under the Apache License 2.0. Those components are governed by their own licences; notices are in the App under Settings → About.
6. Bundled sound assets
The App’s 80 bundled sounds are original and are released under CC0 1.0 Universal. Your rights to those sound files are those of CC0, which are separate from the licence to the software.
7. User-created content
The licence to use the software is separate from your rights in the music you make. We do not claim ownership of your projects or exported audio. See the Terms of Use, section 9.
8. Updates and support
Updates may be provided through Google Play and are covered by this EULA. We aim to provide reasonable support through the Support page but do not promise any particular response time or that every device is supported.
9. Warranty disclaimer and limitation of liability
To the extent permitted by law, the App is provided “as is” without warranties, and we are not liable for indirect or consequential loss or for lost data. Mandatory consumer guarantees and liability that cannot lawfully be excluded remain unaffected.
10. Termination
This EULA ends automatically if you breach it. You may end it any time by uninstalling the App. Sections that by nature should survive will do so.
